 If you have been arrested for committing a serious offence, you are immediately going to need a criminal lawyer to advise you, and should the case come to court, a team to defend you. Your lawyer should be able to tell you into what category of offence or crime your act falls.</p>
<p>Canadas criminal law is under the jurisdiction of the federal government, but the provincial governments have the power to enforce and prosecute according to the law, through their law-enforcement agencies, namely the police.</p>
<p>Canadas penal code divides offences into three types:</p>
<p><span id="more-191"></span></p>
<p>Summary conviction offences:</p>
<p>These include most minor infractions that are usually punishable by a fine of up to 00 and / or six months jail-time. The statute of limitations is six months for a summary charge unless an actual crime has been committed. The statute of limitations is set out individually for each type of crime. The police do not need an arrest warrant for this type of offence and the accused does not have to submit his or her fingerprints. The accused is automatically pardoned after three years if no further offence is committed.</p>
<p>Indictable offences:</p>
<p>These are the very serious offences, such as murder, treason, robbery, assault, burglary, rape, arson and larceny.</p>
<p>With the exception of treason which holds a statute of limitations of three years, there is no limitation for serious crimes. The police need an arrest warrant for this kind of offence, and the accused is required to submit finger prints.</p>
<p>Hybrid offences:</p>
<p>These are undecided offences. This type of offence can fall into either category of summary or indictable depending upon the circumstances and the consequences of the offence. The prosecution has yet to come to a decision as to whether the case is to be tried as a summary offence or an indictable offence. Many offences fall into this category. An example of an uncertain offence is driving under the influence of alcohol or drugs.</p>
<p>DUI, or impaired driving as it is called in Canada is normally a summary conviction offence. Penalties of fines and restricting driving, or revoking drivers licenses are more likely to be imposed rather than jail sentences. In Ontario, however, repeated offences can carry jail-time. If the impaired driver is involved in an accident, the charge might become a hybrid offence, and if lives are lost, an indictable offence.</p>
<p>When you are about to be indicted, your criminal lawyer will have to decide a strategy to defend you. He or she will try to find extenuating circumstances that may produce leniency in your sentencing or even get you acquitted. These include duress, intoxication, automatism, or necessity. Automatism will probably require psychiatric evaluation, and intoxication is only a factor in certain crimes. Necessity can include such things as self defence.</p>
<p>The law is very complicated, and that is why it is vital to get a criminal lawyer who is experienced and qualified to defend you in the type of charge you are facing.

<p>Selling your own home can be a time-consuming and frustrating process. Though listing with an agent is probably the best plan, I won&#8217;t leave you do-it-yourselfers without some helpful information. In the right market, it may make sense to save the commission and do it yourself &#8211; if you know what you are doing. Use the outline here to do it right, and to avoid common mistakes.</p>
<p>First Understand Home Value</p>
<p>It&#8217;s not what you think your house is worth, and it doesn&#8217;t matter how much you put into it. The value is only what it&#8217;s worth to potential buyers. See what they&#8217;ve paid for similar homes before you decide on a price. Do a market analysis &#8211; don&#8217;t just guess. Over-pricing can cost you as much as under-pricing.</p>
<p>Selling Your Own Home &#8211; The Rest Of The Story</p>
<p><span id="more-164"></span></p>
<p>Be objective. Get your most honest and open friend to walk through the house with you. </p>
<p>He or she will see problems you didn&#8217;t even know were problems. &#8220;Sell&#8221; the home to him, telling him all the benefits of buying your house, and get his honest opinion of your sales technique.</p>
<p>Make a thorough plan. What will your kids say to those who call? Where will you close? Will your documents be prepared by an attorney? Plan well, and it will all go smoother.</p>
<p>Make a list. What needs to be repaired, cleaned, changed, or removed? Always do the most obvious things first. More on this in coming chapters.</p>
<p>Prepare the house for sale. Beyond the obvious cleaning up and repairing, look for easy improvements that will increase the value of the home.</p>
<p>Prepare your sales pitch. List any questions buyers might have, and be ready with answers. Prepare comparison sheets showing other home sales, so buyers can see the value in your home. Make a map showing nearby stores and libraries, etc. Sell the benefits, not the features. Never say &#8220;near stores.&#8221; Instead, say &#8220;You can walk to the store in five minutes.&#8221; Don&#8217;t just say &#8220;garage.&#8221; Try &#8220;No chipping ice off the windshield in the morning.&#8221;</p>
<p>Put crucial information your advertising. Include the square feet, the number of bedrooms and bathrooms, the address, your telephone number, and the price. If you leave out the price, some buyers just won&#8217;t call, plus you&#8217;ll waste time with others who shouldn&#8217;t be calling.</p>
<p>Listen to buyers. One mistake sellers make talking to buyers is to get defensive about their home. Listen to the criticisms, and resolve them or ask how important the issue is to the buyer. In other words, try to learn a little about selling.</p>
<p>Have forms ready. You don&#8217;t want a buyer to say, &#8220;I love the house. I&#8217;ll get an offer form somewhere tomorrow and then I&#8217;ll be back.&#8221; He might see another home he likes before then. Have copies of an &#8220;offer to purchase,&#8221; or &#8220;purchase agreement&#8221; form ready. In real estate it is only legally binding if it is in writing. When you are selling your own home, you need to have ready the same tools that a real estate agent would have.</p>
<p>Have a clear sales agreement. Be sure it&#8217;s understood by both sides. What happens, and when? What if the buyer doesn&#8217;t get financing? What&#8217;s included with the sale? When will the buyer take possession? Who pays the closing fee and the transfer tax? More on this in later chapters.</p>
<p>Make closing easy. Choose a closing company before you even have an offer. Have documents ready to sign. Prepare answers to likely questions. This will probably be the largest financial transaction in your buyer&#8217;s life, so make him comfortable.</p>
<p>Use this basic outline, and you&#8217;ll be doing better than the average seller when selling your own home.<br />

Students can enter career training at several educational levels to prepare themselves for the field. Through criminal justice career education possibilities students can step into a large number of careers.</p>
<p>The identification and pattern of criminal behavior is explored during training. Programs examine at what level society can manage crime and delinquency. The legal methods used in the United States to solve crimes and work with criminals is explored along with appropriate punishment. Most careers require students to have either an associate&#8217;s or bachelor&#8217;s degree. Advanced training is not required unless students desire to step into leadership roles. Inside criminal justice degree programs students typically take in-depth specialization courses that prepare them for their professional goals.</p>

<p>Before Charges are Filed</p>
<p>It is essential to retain an experienced criminal defense lawyer as soon as possible after the accused is arrested. In fact, if the police contact the accused during their investigation but before arrest, it is time to consult with a criminal defense lawyer. As the attorney discusses the investigation with the detective he might be able to convince the police not to make an arrest at all or to arrest on lesser charges. One of the attorney&#8217;s primary functions is to attempt to reduce or eliminate the charges. That is the underlying thrust behind motions to dismiss throughout the entire case: to reduce or eliminate charges.</p>
<p>After the arrest there is a slight window of two to three weeks before the State Attorney&#8217;s Office files the formal charges. This is a crucial time window. Wouldn&#8217;t it be great to be in the conference room when the State&#8217;s case filing attorneys are considering what, if any, charges they will file in this case? Well, the accused cannot be there. </p>
<p><span id="more-268"></span></p>
<p>The experienced criminal defense lawyer knows just how to present the facts in support of his client&#8217;s position in front of this esteemed group of prosecutors so that they will give due consideration to the arguments for reducing or eliminating charges. This powerful tool takes place before they actually file charges. This, too, is akin to a motion to dismiss or reduce charges that the attorney can work with even before the case begins in Court.<br />After Charges Have Been Filed</p>
<p>Once the State Attorney&#8217;s case filing section decides on the charges, a written Information is filed with the Clerk in the Court file. At this point, these are the formal charges that the attorney will be fighting on his client&#8217;s behalf. The Court will set an Arraignment, which is the first Court hearing. The formal charges may be read aloud in open Court unless the accused decides to waive the reading. Next the accused must make a choice between two possible pleas. The attorney will inform the Court if the accused intends to plead guilty [meaning a jury trial is not wanted and the Court can pronounce sentence right away], or the accused can plead not guilty [meaning a jury trial is desired and none of the Constitutional rights will be waived].</p>
<p>If the attorney selects to file a Written Plea of Not Guilty and Demand for Jury Trial with the Court prior to the date of the Arraignment, the Court will waive the presence of the defendant and his/her attorney and the reading of the charges is also waived. This procedure can save the defendant a trip to the courthouse. This is the only Court hearing where the presence of the defendant can be automatically waived. [If a defendant lives out of state or has some particular impediment to appearing in Court personally, the attorney can file a written motion for the Court to waive his/her appearance and obtain an Order to that affect. This is beyond the scope of this article.]</p>
<p>Whether the defendant appears for formal Arraignment or waives it by Written Plea filed by his/her attorney beforehand, the attorney will always ask the Court for 15 days for the filing of Defense motions. The rules of Court generally set the time for making motions to dismiss at the time of Arraignment. It is rare that the lawyer could be prepared so soon in the representation to articulate grounds for dismissing the charges in writing including case citations of law. This is why the attorney asks for more time to investigate whether there are viable grounds for filing a Motion to Dismiss and to perform the proper legal research. If the grounds for dismissal are based on fundamental rights [i.e., rights that arise under the U.S. Constitution] they can be raised at any time during the pre-trial procedure.</p>
<p>The Written Motion to Dismiss</p>
<p>There are two basic divisions of the Court system: civil cases concern money issues; criminal cases concern liberty interests. While in civil cases the motion to dismiss is filed with every answer to every complaint and is very often granted by the Court, in criminal cases a motion to dismiss is less often used. That is because in criminal cases the State brings the charges and only the State can change or alter the charges unless there are clear grounds for the Court to take control and dismiss as a matter of law. For example, if the statute of limitations has run, the Court can determine that from the record and dismiss that charge as a matter of law.</p>
<p>The criminal law motion to dismiss is actually more like the civil law motion for summary judgment. In both of these, the party making the motion is saying in effect that there are no material facts in dispute and therefore the law requires that the charge/complaint be dismissed. In civil cases, the other party will try to file affidavits or statements under oath that controvert the facts and thus require the case to go to a jury to decide the factual questions. In criminal cases, the State can file a traverse which is a response outlining the facts that are actually in dispute. If the State can show that there is a factual dispute, the motion to dismiss must be denied and the case must go to the jury to decide those facts.</p>
<p>The motion to dismiss must be made in writing and state that there are no material disputed facts and that the undisputed facts do not establish a prima facie case of guilt or that they do establish a complete defense. The attorney will cite to police reports, affidavits, depositions under oath, etc. to support the motion to dismiss. The motion must be sworn to under oath by the defendant or by someone with personal knowledge. All defenses available by plea, other than not guilty, must be raised by a motion to dismiss whether they relate to matters of form, substance, former acquittal, former jeopardy, not guilty by reason of insanity, or any other defense.</p>
<p>The function of the attorney remains constant. He is consistently trying to reduce or eliminate charges.</p>
<p>The State&#8217;s Response to the Motion to Dismiss</p>
<p>If the motion is sufficient on its face, the State must oppose by either traverse or demurer. A traverse says that the motion&#8217;s factual assertions are false or incomplete and issues of fact remain as to whether the defendant committed the crime. A demurrer says that even if the facts alleged by the defendant are true and complete, dismissal cannot be granted as a matter of law. If the state&#8217;s traverse or demurrer indicates ultimate facts that raise a material issue of fact in the case, the Court must deny the motion to dismiss.<br />Evidentiary Uses</p>
<p>Sworn motions to dismiss and traverses are sharp tools in the criminal defense lawyer&#8217;s hand as he crafts this pretrial battle. Even more they are power weapons for the trial because they are now in the record as admissions by party opponents. They will be admissible as substantive evidence if any of the State&#8217;s witnesses change their testimony slightly at trial. As always, they can be used to impeach the witness&#8217; credibility.</p>
<p>Now it can be better understood why experienced criminal defense lawyers, whose role is to reduce or eliminate charges, seek to utilize the powerful tool of motions to dismiss in order to better their client&#8217;s position during both pretrial and jury trial.</p>

<p>The ancient art of beading has experienced a resurgence of popularity over the last decade and many new uses are surfacing. The term beading can encompass many forms from stringing to intricate weaving, but what I want to focus on here is a brief overview of a more free-form beadwork type which overlaps many styles; mixed media beading.</p>
<p>By its very name, mixed media beading incorporates beads, but the mixed media part could be anything you feel drawn to and that is what I find most alluring. Is your creative experience with paints, fabric, glass, paper, photography, resin, yarn, wire, stamping, friendly plastic, polymer clay? Great!  Incorporate those items to produce something truly unique&#8230;your own look.</p>
<p>There a just a few basic things to consider in mixed media beading: the backing or substrate to be embellished; which items to include; how you will attach them and then, how to finish your piece, which is often the hardest part.</p>
<p><span id="more-116"></span></p>
<p>Substrates could be fabric for an art quilt look, or wood, polymer clay, or foam for a mosaic result, or a glass picture frame for a vibrant sun-catcher. </p>
<p>Using a stretched canvas as a substrate is a possibility that would make finishing a much simpler task.  You can mosaic with beads and other tessarae over any existing form.  Do you have an old wood birdhouse or glass gazing ball that needs an update?</p>
<p>The method of attaching embellishments naturally depends on your substrate. Fabric calls for stitching or a light stringing wire, perhaps yarn or embroidery floss, or you could use an iron-on fusing medium. The mosaic and sun-catcher techniques require a mosaic or clear drying jewelry glue.</p>
<p>Finishing for a fabric piece could be a binding or a machine or hand worked overstitch, or simply tuck a border under and staple the piece to a stable backing frame. </p>
<p>For a mosaic or sun-catcher, you might grout, use a spray or brush on a glossy medium which drops into the negative space, or pour tiny no-hole micro beads into a glue line between the bigger beads. Chain, ribbon or satin rope could also fill those spaces.</p>
<p>There are so many possibilities with mixed media beading and this has just been a brief outline to get you thinking outside of your normal craft.  I&#8217;ll go into more detail about specifics in future technique focused articles on bead embroidery, bead mosaics and art quilts.</p>

<p>International Franchise Association (IFA) CEO Stephen J. Caldeira will speak to New England Franchise Association (NEFA) on Tuesday, November 9th at the Marriott Hotel, 2345 Commonwealth Avenue, Newton, MA.</p>
<p>Caldeira is the new President and CEO of the (IFA), the world&#8217;s oldest and largest organization representing franchising worldwide. He started his new position as IFA President on June 15th, 2010. Caldeira has New England ties and was most recently director of Global Communications for Dunkin Brands.</p>
<p>&#8220;Franchising is not immune to the current economic shift,&#8221; noted Caldeira. He added, &#8220;I&#8217;ll talk about how the franchising community is impacted, the trends that are apparent and the future of where franchising is heading.  These are not times to be reactive.  Franchisors are taking bold steps to maintain momentum.&#8221;</p>
